Intersell Ventures, LLC ("Intersell") has developed this Privacy Policy to help you understand how we collect, use and disclose information we may collect from you and/or your device (computer, phone or other mobile device), or that you may provide to Intersell while using our websites and apps, including but not limited to websites and mobile applications Lil Wish Lanterns and Wishimals, as well as our websites at lilwish.com and lilwishlanterns.com (collectively "Intersell Services").
Some of our websites and mobile applications are directed to children and adults. A “child,” as it is used here is defined as a person under the age of 13 in the United States. Other jurisdictions, such as European Union states, may define children differently. See also, 10. Children
By using the Intersell Services, you agree to how Intersell collects, uses and discloses information that is collected from you. If you are under 18 years old, you acknowledge that your legal guardian has consented to this Privacy Policy. This Privacy Policy is an integral part of the Terms of Service governing your use of Intersell Services.
If you or your legal guardian do not accept or understand this Privacy Policy, please do not use the Intersell Services.
1. Definitions
The following defined terms shall have the meanings set forth below:
• "Financial Information" means information relating to payments and billing (e.g., name, account information, billing address) provided by you. All Financial Information is collected for billing and payment purposes only and will be protected and administered by Intersell and/or our authorized third party partners.
• "Non-Personal Information" means information that, by itself, does not identify a specific individual or entity (e.g., demographic information, usage data or downloads).
• "Personal Information" means specific identifiable information about an individual or entity which may be used to identify, contact or locate that person or entity (e.g., name, mailing address, Device ID (defined below), email address or phone number).

2. What Information Is Collected?
Information You Provide. Intersell may receive and store any Personal Information, Financial Information and/or Non-Personal Information that you provide when you interact with Intersell. Some features and/or functionality of the Intersell Services may be unavailable if you choose not to share certain information. Intersell may use information you provide to communicate with you and to improve the Intersell Services. Here are some examples:
• Email Communications. If you contact us via email, Intersell may use your Personal Information to send you emails related to promotions and/or events. You can opt out of receiving promotional emails by following the instructions in the relevant correspondence. Once Intersell has processed your opt-out request, Intersell will not send you further promotional emails unless you later opt back in. Whether you opt out of receiving promotional emails or not, Intersell reserves the right to email you with respect to important account information, notices or changes relating to the Intersell Services.
• Contact Us. If you choose to use our "Contact Us" or “Help” forms you may be asked to provide Personal Information and describe the purpose for which you are contacting Intersell. If Intersell is aware that you are under the age of 13, Intersell will delete your email address once your request has been fulfilled.
• Geo-Location Data. Intersell does not ask you for or track any device-generated location information at any time while downloading or using Intersell' mobile applications or services, but other information collected, such as an IP Address, may correspond to your country of origin.
• Push Notifications. On occasion, Intersell will send you push notifications when using Intersell' mobile applications to alert you to in-game events or provide other account information that may be important to you. If you no longer wish to receive these types of communications, you may opt-out from receiving them by turning them off at the device level through the notification settings of your mobile device.
• Other Information. You may provide other Personal and Non-Personal information whenever you interact with the Intersell Services, including, without limitation, when you search the Intersell Services, participate in a contest, survey or questionnaire, place an order, or communicate with Intersell by phone or email.
With any of the above actions, you may supply Intersell with information such as your name, address, phone number, alternate contact information, information about your use of the Intersell Services, personal descriptions and product descriptions.
Information Collected Automatically or Through Technology. Intersell may receive and store certain Personal Information and Non-Personal Information whenever you interact with Intersell. While you are able to visit the Intersell Services and remain anonymous, Intersell and/or Intersell' third-party service providers may still collect Personal and Non-Personal Information through technological means. Such information may be gathered by the following methods:
• Tracking. Technologies such as cookies, beacons, tags and scripts are used by us and our partners, affiliates, and service providers. These technologies are used in analyzing trends, administering the site, tracking user movements around the site or service, and to gather demographic information about our users in aggregate. We may receive reports based on the use of these technologies by these companies on an individual as well as aggregated basis.
• Device Information. When you download and use the Intersell Services, Intersell automatically collects information on the type of device you use, operating system, application version, and the persistent device identifier assigned to your device by its manufacturer ("Device ID"). You consent to Intersell collecting this information.
• Metadata. “Metadata” is data collected and used to facilitate the Intersell Services, monitor system usage, prevent fraud, and for other services. Some examples of metadata that Intersell may collect and analyze include, without limitation, the Internet protocol (IP) address used to connect your computer to the Internet, computer and connection information (such as browser type, version, and time zone setting, browser plug-in types and versions, operating system, and platform), the full Uniform Resource Locator (URL) click sequence to, through, and from the Intersell Services, including date and time, cookie number and any products, services or features you use or interact with arising out of or in connection with your use of the Intersell Services.
• Log files. As most websites do, Intersell gathers certain information automatically and stores it in log files. This information may include internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and/or clickstream data.
• Tools. Intersell may use software tools to measure and collect information about your use of the Intersell Services, including, without limitation, page response times, upload and file transfer errors, interaction information (such as scrolling, clicks, and mouse- overs), features use, purchase tracking and order fulfillment and methods. Sometimes, you will have a choice whether or not to provide information, but if you fail to provide certain information it could impact some features and/or functionalities of the Intersell Services.
Information from Other Sources. Intersell may receive information about you from Intersell' third-party service providers, or other sources such as purchase or redemption information, Intersell Services usage, payment information, reporting information, page-view information, technical, fulfillment, advertising, and search information.
Mobile Analytics. Intersell uses mobile analytics software to better understand the functionality of its apps on your phone. This software may record information such as how often you use the application, the events that occur within the application, aggregated usage, performance data, and where the application was downloaded from. Intersell does not link the information stored within the analytics software to any personal information you submit within the application.
Local Storage Objects. Intersell uses Local Storage Objects (LSOs) such as HTML 5 or Flash to store content information and preferences. Third-parties with whom Intersell partners to provide certain features on Intersell' site or, where applicable, to display advertising based upon your Web browsing activity use LSOs such as HTML 5 or Flash to collect and store information.
LSOs act like cookies in that they store information to provide you with a more customized experience, but LSOs can store complex data that cookies cannot, and LSOs are not deleted or rejected if you set your browser to delete or reject cookies. The information stored in any LSO deployed by our Sites is not used to profile or track you online. Although browser settings will not allow you to manage LSOs, you may be able to manage them in other ways. 3. How Information Is Used, Shared and Disclosed.
Intersell does not sell, and generally does not disclose, your Personal Information to third-parties without your consent.
Intersell uses Personal, Non-Personal, and Financial Information, among other things, to monitor system performance, analyze internal business systems, improve the Intersell Services, fulfill requests for additional products and services, contact you about promotional and marketing activities, provide customer support, deliver advertising, and conduct research. The use and protection of information is an important component of Intersell' business. Situations in which Intersell shares or discloses your information also include:
• Legal. Intersell may disclose information you provide to respond to subpoenas, court orders, requests from authorities, and other legal processes, and to establish/exercise Intersell' legal rights. Intersell may also disclose your information to defend against legal claims when Intersell believes that disclosure is necessary to protect Intersell' rights, protect your safety or the safety of others, investigate fraud, or respond to a valid government request. Intersell may share Personal Information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, and situations involving potential threats to the physical safety of any person, violations of Intersell' Terms of Service, or as otherwise required by law.
• Business Transfers. As Intersell continues to develop its business, Intersell may reorganize as a business entity, acquire entities, subsidiaries, or business units, or enter into joint ventures with third-parties. In any of these types of transactions, any information you provide may be one of the transferred business assets (subject to any pre-existing privacy notice unless you consent otherwise). In the event that all or substantially all of Intersell' assets are acquired or Intersell merges with a third-party, your information will likely be one of the transferred assets. You understand and agree that Intersell reserves the right to transfer any information collected from you in the case of any such transfer. In such an event, Intersell will use reasonable efforts to notify you before Personal Information about you is transferred and becomes subject to a different privacy policy.
• Affiliated Businesses We Do Not Control. Intersell may use third-party companies and individuals to perform functions on Intersell' behalf. You may find a list of third-party operators here:

* Some of our third-party providers may share persistent identifiers with other third parties to support their own internal operations, for example, collecting device data for fraud detection. Intersell confirms with these third party that such collection and processing is strictly limited by contract for the specific purposes and that information may not be used or shared for any other purposes, including for behavioural advertising or to amass a profile on a user of Intersell apps. xamples include fulfilling orders, processing payments, hosting, data storage, sending postal mail and email, removing repetitive information from customer lists, analyzing data, providing marketing assistance, providing search results and links (including paid listings and links), processing credit card payments, and providing customer service. Intersell will provide such entities with access to certain information needed to perform their functions, but will take measures to ensure that they may not use it for other purposes. Intersell shares information only as described above and with third-parties that are either subject to this Privacy Policy or to a privacy policy that is at least as protective as this Privacy Policy.
We may share Information for other reasons in the future, which we will disclose and describe to you directly or in updates to this Privacy Policy.

4. Security
The security of your Personal Information is important to Intersell. Intersell follows generally accepted industry standards to protect the Personal Information submitted to Intersell, both during transmission and once it is received. However, no method of transmission over the Internet or method of electronic data storage is 100% secure. Therefore, Intersell cannot guarantee the absolute security of data it stores. Although no security system is completely secure, Intersell and its third-party partners and vendors take appropriate security measures to protect against unauthorized access or disclosure of the information collected by Intersell. For Intersell, this includes, but is not limited to, ensuring that all Personal and Financial Information is disclosed only on a "need to know" basis and ensuring that all Personal Information collected by Intersell is obtained via secured connections and protected and encrypted (using at minimum Transport Layer Security (TLS) 1.2 encryption protocol) by industrial grade security software to guard against unauthorized access.
5. Advertising
Intersell may partner with third parties to display advertising on its websites and Apps, or to manage its advertising on other sites or services. Some of the advertising displayed on our services is contextual, meaning those that relate to the content you are viewing. We do not collect personal information to serve contextual ads to users.
On our services that are directed to a general audience or where we have determined the age of the visitor is over the age of 13, Intersell collects your device ID and may pass it to advertisers to enable interest-based advertising. Interest-based advertisements may be served to you based on your browsing activities and interests on our sites and services and across other services and platforms. For interest-based ads, third-party partners may use cookies or similar technologies that collect personal information in order to provide you with advertising based upon your browsing activities and interests.

You may refer to our list of third parties in section 3 of this policy to see which of our third-party service providers offer consumer opt-out choices through the Digital Advertising Alliance’s (DAA) and/or Network Advertising Initiative’s (NAI) sites. Intersell may include third-party ads in free versions of its mobile applications, in which case we may collect your Device ID and pass it to advertisers to enable certain advertising.
For users that have identified themselves as under the age of 13 or are presumed to be under 13 based on the target audience of the app (or the legal threshold age in your country of residence), we will not allow third parties to collect personal information to track or serve interest-based ads. We do not collect personal information to serve contextual ads to users.
6. Social Media Features and Tools
The Intersell Services may include integrated social media features and tools, such as the Facebook login or "Like" button, the YouTube "Share This" button, and interactive mini-programs that run in the Intersell Services. These Features may collect information on your IP address, which page you are visiting on Intersell' site, and may set a cookie to enable the feature to function properly. Social media features and tools are either hosted by a third-party or hosted directly on the Intersell Services. Your interactions with these integrated social media features and tools are governed by the privacy policies of the companies providing them. These features such as Facebook login, do not apply to our child directed apps.
7. Links to Other Sites
The Intersell Services contain links to other sites that are not owned or controlled by Intersell. Please be aware that Intersell is not responsible for the privacy practices of such other sites. Intersell encourages you to be aware when you leave Intersell' site and to read the privacy statements of each and every website that collects personally identifiable information. This Privacy Policy applies only to information collected by the Intersell Services.
8. Access/Data Retention
We keep Personal Information for as long as is appropriate or relevant for the practices described in this Policy, including accessing and servicing accounts, providing help to players, communicating with parents and guardians, resolving disputes, and as required by law.
Parents have the right to consent to the collection and use of personal information from their child without also consenting to its disclosure to third-parties. If you or your child's information changes, or if you no longer desire the Intersell Services, you may make corrections and updates, delete inaccuracies, or request deletion by updating your account information within the relevant Intersell Services or by contacting Intersell at privacy@Intersell.com.
9. Where we store information
Information we store may be stored both within and outside of the United States. If you live outside of the United States, you understand and agree that we may transfer your information to the United States. Intersell is subject to U.S. laws, which may not afford the same level of protection as those in your country.
10. Special Notice Regarding Children
Some of our services are directed to an audience that includes children while others are directed to a general audience. The age of consent regarding privacy and data may differ depending on your locale and jurisdiction.
For our general audience services, Intersell does not knowingly collect Personal Information from persons under the age of 15. If it comes to Intersell' attention that Personal Information has been collected from a person under the age of 15, Intersell will delete this information as quickly as possible. If you believe that Intersell may have Personal Information from or about a child under the age of 15, please contact Intersell at support@Intersell.com.
Where Intersell requires device owners to specify their age or where the target audience is presumed to be a child under 13, it does not collect personal information from users without a lawful basis such as to support the internal operations of our services or with parental consent before any Personal Information is collected.
11. California Privacy Rights
Since 2005, California Civil Code Section 1798.83 permits our customers who are California residents to request certain information regarding disclosure of personal information to third parties for their direct marketing purposes. You are hereby notified that we do not share our customers’ personal information with unaffiliated third parties for their own direct marketing purposes.
The California Consumer Privacy Act (CCPA) also provides California residents with specific rights regarding their personal information. You have the right to request that Intersell disclose to you certain specific information about our collection and use of your personal information over the past 12 months.

Only you or a person registered with the California Secretary of State that is authorized to act on your behalf may make a verifiable consumer request in connection with your rights under the CCPA. You may also make a verifiable consumer request on behalf of your minor child. You may only make a verifiable consumer request for access or data portability twice within any 12-month period. The verifiable request must include the following:
• Sufficient information for us to reasonably verify that you are the person about whom we connected personal information, or that you are the authorized representative of that person, and;
• A description of your request, with sufficient detail for us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with personal information unless we can verify your identity or your authority to make the request, and confirm that the information requested relates to you.
We will only use the personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request, and to research and fulfill the requests that are verified.
12. California Privacy Rights for Minor Users
Since January 1, 2015, California Business and Professions Code Section 22581 permits you, if you are a California resident under the age of 18, to view, correct, or remove information provided by you or publicly posted by you.

We will be happy to review, update, or remove Information as required by law. Residual copies of information or content that have been removed from your account may remain in our backup systems for approximately one month. We may still retain your information required to resolve disputes, enforce our user agreement, or comply with legal requirements; in this case, your personal information will be blocked from use for any other purpose.
13. Conditions of Use/Changes to This Privacy Policy
Intersell may update this Privacy Policy to reflect changes to information practices. If Intersell makes any material changes, Intersell will notify you by email (sent to the email address specified in your account) or by means of a notice on Intersell' website (www.Intersell.com) prior to the change becoming effective. Intersell encourages you to periodically review this page for the latest information on its privacy practices. If Intersell makes material changes to how Personal Information collected from children under age 15 is used, Intersell will notify parents by email in order to obtain verifiable parental consent or, if Intersell does not have such email addresses to contact parents directly, by reasonable means on Intersell' website for the new uses of the child's Personal Information.

We are a participating member of the CARU COPPA Safe Harbor Program. Specifically, Tag with Ryan is certified to meet established online information collection, use and disclosure practices, however, we take steps to confirm that all of our Intersell Services follow the applicable data collection guidance and principles of CARU’s COPPA Safe Harbor Program.
